Why is it more fun in a party when you are doing something illegal?

Smoking Ban Heats Up:
Last year in May of 2006, the new Smoke-Free Ontario Act came into effect which impacts Toronto city.  

Smoking is now prohibited and illegal in all public places including workplaces across Toronto Ontario, its nightclubs and all other private clubs.

Dr. David McKeown, Toronto’s Medical Officer of Health, had  reported that Toronto’s smoking bylaw has been upheld by a court decision dismissing a restaurant’s attempt to get around the smoking ban by operating as a private club.

The Ontario Court of Justice found that an Ontario’s Restaurant’s attempt to pass as a Heritage Club did not meet the qualifications to be exempted as a private club. The Court levied a $4,500 fine on the restaurant for failing to prohibit smoking, just under the $5,000 maximum.

The Ontario Restaurant also dropped its constitutional challenge of the by-law.

 “This decision should put an end to the use of phony private clubs to get around Toronto’s smoking bylaw,” said Councillor John Filion, Chair of the Board of Health.

 “This is a positive step toward the smoke-free enjoyment of public places that will improve the health of Toronto residents,” Dr. McKeown said.

The Burning Question:
Smoking bans are complied on aircrafts (perhaps because of the limited space in the airplane’s cabin, the ignitable oxygen and related fuel / fume dangers) but people feel that public places, including outdoor patios, have no place for smoking-ban enforcement; their question is: "what’s next?"

A prime example of public non-compliance to smoking bans is featured above in a recent downtown Toronto dance club..
